Credit Card Fraud Charges in Utah

Criminal sections of the Utah Code contain several statutes that relate to what is commonly called "credit card" fraud. The Utah Code uses the term "financial transaction card" to refer to credit cards, debit cards, check guarantee cards, ATM cards, and other banking cards.

Not all credit card fraud charges in Utah will involve an actual credit card. Utah prosecutors can file criminal charges for simply possessing information from another person's credit card, if they can demonstrate that the defendant had the intent to use that information unlawfully. Other criminal credit charges can involve allegations that a defendant forged another person's signature on a credit card receipt  or sales draft, or submits a fraudulent application for a card. Other criminal charges can be filed if a person creates a counterfeit financial transaction card or uses a fraudulent card. But perhaps the most common credit card fraud charges involve the unauthorized use of a financial transaction card or card information.

Depending on the specific allegations, credit card fraud charges can range from misdemeanors carrying the potential of 180 days in jail up to second degree felonies punishable by up to 15 years in prison. While many property crimes in Utah are based on the value of goods taken or amount of money obtained, most common credit card fraud charges begin at the third degree felony level.
