Riverdale Justice Court Information

The Riverdale Justice Court has jurisdiction over misdemeanor charges at the class C and class B level that take place inside the borders of Riverdale, Utah. Examples of Class B and C misdemeanor charges commonly heard in the justice court include charges for drug possession or paraphernalia, DUI, domestic violence, and shoplifting. The Riverdale Justice Court also has jurisdiction over most traffic cases occurring within city limits.

A conviction for a class C misdemeanor can result in up to 90 days in the Weber County jail; and a class B misdemeanor conviction can result in up to 180 days in jail. In addition to the potential for time in jail, class B or C misdemeanor convictions in a justice court carry the potential for fines along with other collateral consequences such as losing your driver’s license or right to own or possess a firearm. Some convictions in a justice court can also be used as enhancements for subsequent felony charges.     Case Results – Select Victories in Utah Criminal Defense

    Victories in Utah Criminal Defense Cases

    Client charged with felony aggravated assault for using broken bottle as a weapon. Defense case focused on self-defense, resulting in not guilty verdict by the jury at trial.

    Client pulled over by police for investigation of DUI. Mr. Howard filed a motion to suppress challenging the basis for the warrantless search and seizure. Police had received a report that client might be drunk. By challenging the basis for the report and demonstrating that police observation of client’s driving for nearly two miles showed no traffic violations or other indications of impairment, the prosecutor conceded error and moved to dismiss the DUI.

    First-degree felony burglary charges with gang enhancement were filed based on client’s participation in burglary planned by other individuals. Based on client’s peripheral involvement and evidence his conduct was out of character, prosecutor consented to abeyance agreement at misdemeanor level that would ultimately lead to case dismissal.
