Will I have to get an ignition interlock if I am convicted of
DUI in Utah?
If you are convicted of any
DUI in Utah, a judge may order that you
install an ignition interlock device in any vehicle that you drive.
As long as the judge does not impose the entire jail or
prison term and places you on probation, a judge in a Utah DUI
case has the option of requiring the installation of an
ignition interlock device.
There are also a number of circumstances in a DUI case under which
Utah law says that a judge
shall
require an ignition interlock device to be installed. These
include:if you are under the age of 21; if you are an
alcohol-restricted driver ("ARD"); if your blood or breath alcohol was
more than twice the legal limit (2 x
.08 = .16). Under some circumstances, a judge may decline to
order the ignition interlock device, but must put on the record the
reasons for not ordering the ignition interlock.
If you are caught driving without a required
ignition
interlock device
in Utah, you may face additional criminal charges, as well as
an
extension of the period that you are required to have an ignition
interlock device in your car.
More significant than an ignition interlock device, you may also be
facing jail time and potentially thousands of dollars in fines and
other costs - just for a first DUI.
