District Court in Weber County - Jurisdiction

District courts, under Utah law, are considered courts of general jurisdiction and can hear any level of criminal charge. The district courts have exclusive jurisdiction over all felony and class A misdemeanor charges. These higher-level charges must be filed in the district court despite a justice court with geographic jurisdiction.

District courts are able to hear lower level misdemeanor cases when no justice court has geographic jurisdiction over the matter. Because Weber County has no county-wide justice court, cases involving only class C or class B misdemeanors committed in unincorporated areas of the county should be filed directly in the district court. Cases with only class C or class B misdemeanor that occurred within a city having its own justice court should be filed in the city justice court.

The Ogden District Court also has jurisdiction over de novo appeals from all justice courts in Weber County. Because justice courts in Utah are not considered to be "courts of record" an appeal from the justice court is normally in the form of a trial de novo or hearing de novo in the district court.
