Midvale City Justice Court – Criminal Defense

Under Utah criminal law, the Midvale City Justice Court has jurisdiction to hear only class B misdemeanors and below. A conviction for a single class B misdemeanor in the Midvale City Justice Court is punishable by up to 180 days in the Salt Lake County Jail and nearly $2,000 in fines and surcharge.

    Victories in Utah Criminal Defense Cases

    Client charged with felony aggravated assault for using broken bottle as a weapon. Defense case focused on self-defense, resulting in not guilty verdict by the jury at trial.

    Client charged with felony insurance fraud after claiming work-related injury prevented him from returning to work. Insurance investigators obtained video that included client kicking soccer ball in his yard. Government allegations of fraud were rebutted by medical records and prior administrative adjudications. Client’s job required heavy lifting. The claimed injury did not prevent him from kicking a ball but did prevent him from lifting. Prosecutor conceded error and voluntarily dismissed the case.

    First-degree felony burglary charges with gang enhancement were filed based on client’s participation in burglary planned by other individuals. Based on client’s peripheral involvement and evidence his conduct was out of character, prosecutor consented to abeyance agreement at misdemeanor level that would ultimately lead to case dismissal.

      Selected Victories – Utah Criminal Defense





      Client charged with felony aggravated assault for using broken bottle as a weapon. Defense case focused on self-defense, resulting in not guilty verdict by the jury at trial.

      Client pulled over by police for investigation of DUI. Mr. Howard filed a motion to suppress challenging the basis for the warrantless search and seizure. Police had received a report that client might be drunk. By challenging the basis for the report and demonstrating that police observation of client’s driving for nearly two miles showed no traffic violations or other indications of impairment, the prosecutor conceded error and moved to dismiss the DUI.
