A conviction for possession of alcohol by a minor (a person under 21) in Utah can result in a driver license suspension. Entering into an agreement with a prosecutor to have a plea held in abeyance can be one route to avoiding license suspension.
In a DUI case, Utah law allows the Driver License Division to take administrative action to suspend a license before any conviction has been entered or, in some cases, even before the formal DUI charges have been filed in court. Minor in possession of alcohol (MIP) charges are treated differently in that the DLD cannot take action to suspend the minor’s driver license unless a conviction is entered in court.
